TERMS AND CONDITIONS
Purchaser must complete a wellness check with a licensed veterinarian within 72 hours of pick-up from Breeder. If a life-threatening condition is found at the wellness check, Purchaser must notify Breeder within 24 hours of the time of the wellness check of any life-threatening conditions.
If life-threatening conditions are found in the wellness check, Purchaser may return the puppy, at Purchaser’s expense, within 48 hours of the wellness check for a full refund of the price paid for the puppy.
If the wellness check indicates a life-threatening illness and Purchaser decides to return the puppy for a refund, then Breeder may conduct its own wellness check with a veterinarian of Breeder’s choice before issuing a refund.
No refunds will be given if the wellness check performed by either Purchaser or Breeder reveals that the puppy has Parvo, as Parvo may be contracted after the puppy leaves the Breeder.
The treatment of parasites, de-worming, and other non-life-threatening conditions are the sole responsibility of Purchaser.
A warranty against life inhibiting genetic defects is provided until the puppy reaches two years of age. Reimbursement for qualified life inhibiting genetic defects is limited to fifty percent (50%) of the purchase price. Genetic defects that qualify for reimbursement are those related to hip, heart, elbow, patella, eye, or other life inhibiting genetic defects. Reimbursement for qualified life inhibiting genetic defects will be made only when a second opinion from a qualified veterinarian and proof of surgery expenses have been provided to Breeder by Purchaser. An official OFA hip rating will qualify as a second opinion if the dog is positioned correctly for x-ray. Umbilical hernia repairs will be reimbursed but only up to $100. The warranty provided under this paragraph shall only apply to the original Purchaser of the puppy and the transfer of dog ownership shall void any and all warranties. This warranty is void in the event of an indeterminable or inconclusive diagnosis.
The puppy does not come with breeding rights and the Purchaser must spay or neuter the puppy within 9 months of the date of the puppy’s birth. Failure of Purchaser to spay or neuter the puppy within 9 months shall void any and all rights of Purchaser provided for under this Contract. Purchaser must send Breeder proof of spay/neuter by 9 months of age to avoid a lawsuit.
Purchaser acknowledges that Breeder cannot guarantee the size of the puppy, or the color of the puppy’s coat or hair texture, as the color and texture of the coat may change as the puppy ages. By accepting the puppy at the time of pick-up, Purchaser releases Breeder from any liability resulting from the size of the puppy, shedding, and the color and/or texture of the puppy’s coat changing.
Breeder is not responsible for any behavior issues with the puppy once it has been picked up by Purchaser.
Breeder is not responsible for any damages done by the puppy to persons or property once the puppy has been picked up by Purchaser.
All costs incurred by Purchaser not specifically agreed to be paid by Breeder are the sole responsibility of Purchaser.
Breeder shall provide Purchaser thirty (30) days of free health insurance for the puppy purchased in the form of a certificate for health coverage. The health insurance will be with Trupanion insurance company and must be activated by Purchaser within 24 hours of delivery of the puppy to Purchaser or Trainer.
The terms and conditions of this Contract shall expire within 12 months of the date of receipt by Breeder of Purchaser’s deposit and the prices are only guaranteed for 12 months. If Purchaser desires to continue to be on the wait list for a puppy, then Purchaser must sign a new Contract and Purchaser’s deposit will be transferred to the new Contract.
Purchaser and Breeder agree that all the terms, conditions, representations and agreements contained in the Application previously submitted by Purchaser to Breeder, are hereby incorporated by reference thereto, and specifically made a part of this Contract and shall be enforceable as if fully set forth in this Contract.
This Contract shall be in full force and effect upon the execution hereof by all parties hereto, and an executed copy of this Agreement shall have the same force and effect as the original.
Neither this Contract nor any right hereunder may be assigned by Purchaser without the prior written consent of Breeder. Subject to this condition, the Contract and all the provisions thereof shall inure to the benefit of and be binding upon the parties and their respective heirs, representative, successors, and assigns.
No modifications or amendment of this Contract shall be valid or binding unless such modifications or amendment is in writing, duly dated and signed by both parties.
This Contract shall be subject to the laws of the State of Illinois and any cause of action arising out of this Contract shall be filed in Tazewell County, Illinois.
